These Terms of Service constitute a legally binding agreement between you and Ghostware LLC, doing business as TCG Repair (“TCG Repair,” “Company,” “we,” “us,” or “our”).
These Terms govern your use of the TCG Repair website, submission forms, order-tracking tools, mail-in services, convention services, cleaning services, inspection services, pressing services, dent-reduction services, slab-removal services, condition-reporting services, high-value handling services, and all related products and services collectively referred to as the “Services.”
By using our website, submitting an order, checking an acceptance box, electronically signing a treatment authorization, making payment, shipping cards to us, or delivering cards to us in person, you acknowledge that you have read, understood, and agreed to these Terms.
Do not submit cards or use the Services unless you agree to these Terms.
1. Eligibility and Authority
You must be at least eighteen years old and legally capable of entering into a binding agreement to purchase Services.
By submitting a card or other collectible to TCG Repair, you represent and warrant that:
You are the lawful owner of the item or are fully authorized by its lawful owner to submit it.
You have the authority to authorize the requested Services.
The item is not stolen, counterfeit, unlawfully obtained, or subject to an ownership dispute, lien, security interest, or other adverse claim.
All information you provide is accurate and complete.
You will not use the Services to facilitate fraud, misrepresentation, or deceptive resale practices.
TCG Repair may request proof of identity, ownership, authority, purchase history, or declared value before accepting or performing Services.
2. Description of Services
TCG Repair provides professional trading-card cleaning, inspection, conservation, preparation, documentation, and related services.
Services may include:
Clean and Inspect
Clean and Press
Clean, Press and Dent Reduction
Slab Removal
Centering Reports
Detailed Condition Reports
Express Service
High-Value Card Handling
Convention-based services
Other services accepted by TCG Repair in writing
Service descriptions are intended to explain the general nature of the work. The exact methods used may vary based on the card’s age, composition, coating, finish, condition, construction, prior treatment, and risk profile.
TCG Repair does not provide professional grading, authentication, appraisal, restoration certification, financial advice, insurance advice, or legal advice.
3. No Grading Submission Service
TCG Repair does not submit cards to PSA, CGC, Beckett, SGC, or any other grading or authentication company on a customer’s behalf unless expressly agreed in a separate written agreement signed by TCG Repair.
Cards are returned directly to the customer after completion of the Services.
The customer remains solely responsible for:
Selecting a grading company
Preparing and completing a grading submission
Paying grading fees
Selecting declared values and service levels
Arranging shipment to the grading company
Complying with the grading company’s rules
Disclosing prior treatments when required
Evaluating whether a card should be submitted for grading
TCG Repair is not affiliated with, endorsed by, sponsored by, or authorized by any grading company, card manufacturer, game publisher, or intellectual-property owner unless expressly stated otherwise.
4. Order Submission and Acceptance
Submitting an order request does not require TCG Repair to accept the order.
The typical order process is:
You submit an order request and treatment authorization.
TCG Repair reviews the cards, requested Services, declared values, and risk information.
TCG Repair approves, modifies, requests additional information about, or declines the order.
You receive an approved service summary and payment request.
You pay the approved amount.
You receive shipping or delivery instructions.
You send or deliver the cards to TCG Repair.
Your order is not accepted until TCG Repair has approved it and received any required payment.
TCG Repair may:
Decline any card or order
Recommend a different service level
Require High-Value Card Handling
Require additional photographs or information
Require additional insurance
Impose a lower liability limit
Require a separate written agreement
Return a card without performing treatment
Stop treatment when continued work presents an unreasonable risk
No requested service upgrade will be performed without customer authorization when it results in an additional charge.
5. Treatment Authorization
By purchasing or authorizing Services, you give TCG Repair permission to examine, handle, photograph, clean, condition, humidify, press, rest, tool, extract from a slab, sleeve, package, and otherwise treat the submitted card as reasonably necessary to perform the authorized Services.
Depending on the Services selected, treatment may involve:
Surface contact
Cleaning materials
Anti-static treatment
Controlled humidity exposure
Pressure
Extended resting periods
Repeated pressing cycles
Localized hand tooling
Removal from an encapsulated holder
Movement between sleeves, holders, or storage materials
Photography under normal or magnified lighting
You acknowledge that these procedures involve inherent risk, including the possibility that a card’s condition may remain unchanged or become worse despite reasonable care.
TCG Repair will determine the particular tools, sequence, duration, and methods used to perform the authorized Services.
6. Condition of Submitted Cards
Trading cards may contain visible and hidden defects, including:
Creases
Dents
Indentations
Surface scratches
Print lines
Coating defects
Delamination
Foil separation
Brittleness
Moisture damage
Mold
Adhesive residue
Chemical contamination
Warping
Curling
Raised edges
Soft or damaged corners
Structural weakness
Prior undisclosed alteration
Prior cleaning or restoration
Damage concealed by a slab or holder
Some defects may not be apparent until the card is removed from its holder, cleaned, conditioned, placed under magnification, or otherwise handled.
You acknowledge that TCG Repair is not responsible for preexisting damage, latent defects, manufacturing defects, prior alterations, prior treatments, deterioration, or structural weaknesses that existed before the card was received.
Our intake photographs and written observations are not comprehensive condition reports unless you purchase a Detailed Condition Report or High-Value Card Handling.
7. No Guarantee of Results
TCG Repair does not guarantee that any Service will:
Completely remove dirt, fingerprints, dents, bends, curls, scratches, haze, stains, waviness, or other defects
Restore a card to its original condition
Make a card appear new
Improve the card’s grade
Produce any specific numerical grade
Prevent a grading company from identifying treatment
Increase the card’s market value
Prevent future deterioration
Make the card suitable for grading or resale
Cause a buyer or grading company to accept the card
Produce results identical to photographs, videos, or prior examples
Results vary according to factors outside TCG Repair’s control, including:
Age
Materials
Card stock
Coating
Finish
Foil construction
Manufacturing variation
Prior storage
Prior handling
Prior treatments
Environmental exposure
Severity and location of damage
Statements regarding grading readiness, estimated centering, likely condition, or grading potential are opinions only.
8. No Guarantee of Grade or Market Value
Professional grading is subjective and may vary by:
Grading company
Individual grader
Submission date
Service level
Company standards
Technology
Population reports
Market conditions
Prior treatment policies
Authentication determinations
TCG Repair does not guarantee or predict any particular grade, designation, qualifier, authentication result, market price, resale price, collector premium, or investment return.
You may not hold TCG Repair responsible for:
A lower-than-expected grade
A card being rejected
A card being labeled altered, restored, cleaned, counterfeit, questionable, or otherwise ineligible
A card receiving no grade
A change in market value
A lost grading premium
A grading company changing its standards
A buyer refusing to purchase the card
The difference between an expected and actual sale price
Any decision to grade, sell, trade, insure, display, or retain a card is solely yours.
9. Conservation and Alteration Disclosure
TCG Repair intends to perform legitimate cleaning, preparation, and conservation—not deceptive alteration.
Unless specifically disclosed and separately agreed in writing, TCG Repair does not:
Trim cards
Recolor cards
Reconstruct printed imagery
Replace missing card stock
Apply fillers
Reprint damaged areas
Add foreign material to conceal damage
Artificially rebuild corners
Guarantee that treatment is undetectable
You are responsible for complying with all marketplace, auction-house, grading-company, and buyer-disclosure requirements that may apply to serviced cards.
You may not falsely state or imply that a serviced card is untreated when disclosure is legally or contractually required.
10. Service-Level Changes
The Service selected by the customer may not be appropriate after physical inspection.
If TCG Repair determines that a card:
Requires a higher service tier
Requires High-Value Card Handling
Requires additional insurance
Is too fragile to treat
Contains unexpected damage
Presents contamination concerns
Requires services outside the approved scope
TCG Repair may pause the order and contact you.
No additional paid treatment will be performed without your approval. However, TCG Repair may perform minor protective actions reasonably necessary to secure, sleeve, isolate, or safely store the card.
If you decline a recommended service change, TCG Repair may return the card without treatment. Fees already earned for inspection, intake, slab removal, completed work, shipping, or special handling are nonrefundable.
11. Slab Removal
Slab Removal involves physically opening or breaking an encapsulated holder and extracting the card.
You acknowledge that Slab Removal carries risks, including:
Scratching
Cutting
Edge or corner damage
Pressure damage
Contact with plastic fragments
Label damage
Damage caused by an unusually constructed, altered, resealed, counterfeit, or defective holder
Discovery of hidden card damage after extraction
Once a holder is opened, its grading certification, tamper-evident status, warranty, registry status, or resale utility may be affected or destroyed.
TCG Repair does not guarantee that a grading label, slab, insert, hologram, or other packaging component can be preserved.
You must expressly authorize Slab Removal before it is performed.
12. Centering and Condition Reports
Centering ratios, measurements, photographs, annotations, and condition observations are estimates for informational purposes.
They are not:
Formal appraisals
Grading guarantees
Authentication opinions
Insurance valuations
Certifications of condition
Representations that a grading company will use the same methodology
Lighting, perspective, card design, border geometry, printing tolerances, cutting irregularities, and measurement methods may affect the result.
TCG Repair may revise or correct a report if an error is identified.
13. Declared Value
You must provide an honest, reasonable estimate of each card’s current fair-market value before shipping or delivering it to TCG Repair.
Declared value is used for:
Risk review
Service eligibility
High-Value Card Handling requirements
Storage procedures
Shipping recommendations
Insurance coordination
Potential contractual liability limits
Declared value is not an appraisal, guaranteed sale price, insured amount, or admission of value by TCG Repair.
TCG Repair may reject or revise an unsupported declared value. We may request recent sales data, purchase documentation, grading information, photographs, or other evidence.
Unless TCG Repair expressly accepts a higher value in writing, cards submitted without a declared value will be treated as having a maximum value of $100 per card for risk-management and contractual claim purposes, to the fullest extent permitted by law.
Understating a card’s value may result in:
Insufficient insurance
Denial of High-Value Card Handling
Reduced recoverable damages
Cancellation of the order
Return of the card at your expense
You are responsible for updating us if a material valuation error is discovered before treatment begins.
14. High-Value Cards
Cards with an estimated value of $1,000 or more require High-Value Card Handling unless TCG Repair waives the requirement in writing.
TCG Repair may impose additional requirements for high-value cards, including:
Proof of ownership
Proof of value
Signature-required shipping
Specified carriers or shipping methods
Additional insurance
Separate packaging
Video-recorded intake
Custom liability terms
A separate service agreement
Direct pickup or delivery
Restrictions on available treatment
TCG Repair may refuse cards whose value exceeds its insurance, storage, shipping, or operational limits.
High-Value Card Handling is an additional handling and documentation service. It does not guarantee against loss, theft, damage, treatment failure, or carrier loss.
15. Pricing and Payment
Prices are displayed on the website, stated in an approved quote, or agreed to in writing.
You agree to pay:
Approved service fees
Add-on fees
Shipping charges
Insurance charges
Taxes
Storage charges when applicable
Additional charges you approve
Fees associated with returned, declined, or disputed payments
Payment is generally required before you are authorized to ship cards.
TCG Repair may correct pricing errors before accepting an order. Promotional pricing and discounts may be modified or withdrawn at any time before order acceptance.
Bulk discounts apply only as expressly stated and generally do not apply to:
Add-ons
Shipping
Insurance
High-Value Card Handling
Express Service
Special handling
Custom work
TCG Repair may withhold completed cards until all authorized amounts are paid, subject to applicable law.
16. Cancellations and Refunds
You may request cancellation before shipping the cards.
Payment-processing fees, administrative fees, prepaid label costs, or other nonrecoverable expenses may be deducted from a refund.
After cards have been shipped, delivered, checked in, photographed, inspected, removed from a slab, cleaned, conditioned, pressed, tooled, documented, packaged, or otherwise serviced, corresponding fees are nonrefundable.
Once treatment begins, cancellation is subject to TCG Repair’s approval. You remain responsible for:
Work already performed
Intake and inspection
Slab Removal
Materials used
Packaging
Shipping
Insurance
Special handling
Applicable storage fees
Dissatisfaction with an aesthetic result, grading result, resale result, or remaining permanent defect does not automatically entitle you to a refund.
17. Express Service
Express Service provides priority processing but does not guarantee completion by a specific date unless TCG Repair expressly agrees to a guaranteed date in writing.
Express turnaround may be affected by:
Card condition
Required rest periods
Treatment response
Customer approval delays
Shipping delays
Equipment failure
Unexpected order volume
Events outside TCG Repair’s reasonable control
If TCG Repair cannot provide priority processing, its maximum obligation regarding the Express Service charge will ordinarily be to refund the Express Service fee.
18. Turnaround Estimates
All turnaround periods are estimates, not guaranteed completion dates.
Turnaround begins only after:
The package is delivered
The order is identified
The cards are checked in
Payment is confirmed
All necessary authorizations are received
Turnaround does not include inbound or outbound shipping time.
Treatment may require extended conditioning, resting, inspection, or quality-control periods. TCG Repair may extend turnaround when reasonably necessary to avoid unnecessary risk to a card.
TCG Repair is not responsible for losses arising from an estimated completion date, missed sales event, grading deadline, auction deadline, convention, gift date, market change, or similar timing expectation.
19. Inbound Shipping
Unless otherwise stated in writing, you are responsible for securely packaging and shipping cards to TCG Repair.
You are responsible for:
Selecting the carrier
Purchasing tracking
Purchasing insurance
Declaring an accurate shipment value
Using signature confirmation when appropriate
Following our packaging instructions
Retaining shipment receipts
Filing inbound carrier claims
Addressing customs or regulatory requirements
Risk of loss or damage during inbound shipping remains with you until the package is recorded as delivered to and physically accepted by TCG Repair.
A carrier’s delivery scan does not conclusively establish that the package contained the correct cards, was undamaged, or was received in the condition claimed.
TCG Repair is not responsible for:
Lost inbound packages
Misdelivered packages
Carrier theft
Porch theft
Water or fire damage in transit
Customs delays
Inadequate packaging
Incorrect addresses
Missing contents
Undeclared or underinsured shipments
If TCG Repair provides a prepaid label, that does not make TCG Repair the insurer of the shipment or eliminate the customer’s packaging obligations.
20. Return Shipping
Return shipping charges are the customer’s responsibility unless expressly included in a written promotion or agreement.
TCG Repair may select the carrier, service level, packaging method, signature requirement, and insurance option based on the order and customer selections.
You are responsible for providing an accurate and secure return address.
Risk of loss transfers to you when the completed package is tendered to the carrier, to the fullest extent permitted by law. TCG Repair will reasonably cooperate with a properly documented carrier claim but does not guarantee claim approval or payment.
Any carrier recovery will be limited by:
The carrier’s terms
The insurance purchased
The accepted declared value
Proof of value
Packaging compliance
Carrier exclusions
TCG Repair is not responsible for carrier delays, failed delivery attempts, customer unavailability, incorrect addresses, theft after delivery, or damage caused by the carrier.
21. Insurance
TCG Repair does not automatically provide full replacement-value insurance for every order.
You are responsible for reviewing and selecting available insurance or declared-value options.
Shipping insurance may be provided by a carrier or third-party insurer and is subject to its own terms, exclusions, documentation requirements, deductibles, and claim decisions.
TCG Repair does not warrant that:
Insurance is available for every card
A card’s full claimed value is insurable
A carrier will accept the declared value
A claim will be approved
The insurer will recognize projected graded value
The insurer will pay replacement value
An insurance amount does not modify TCG Repair’s contractual limitation of liability unless expressly stated in a separate written agreement.
22. Intake Records
TCG Repair may photograph or record:
The unopened package
Packaging materials
Card count
Card fronts and backs
Visible defects
Slab condition
Labels and serial numbers
Treatment stages
Final condition
Return packaging
These records may be used for:
Identification
Quality control
Order administration
Dispute resolution
Insurance claims
Fraud prevention
Staff training
Legal compliance
Routine intake photographs are not guaranteed to capture every defect.
TCG Repair may retain order, treatment, payment, communication, photographic, and shipping records for a commercially reasonable period.
23. Customer Inspection and Claims
You must inspect returned cards promptly.
Any claim relating to:
Incorrect cards
Missing cards
Shipping damage
Service errors
Documentation errors
Alleged treatment damage
must be reported in writing within seven calendar days after confirmed delivery.
Your notice must include:
Order number
Card identification
Description of the issue
Photographs of the card
Photographs of all packaging
Photographs of any visible shipping damage
Any requested carrier documentation
You must preserve the card, sleeve, holder, box, packing materials, labels, and shipping container while the claim is reviewed.
Failure to provide timely notice or preserve evidence may prevent TCG Repair from investigating and may result in denial of the claim, to the extent permitted by law.
Do not submit the card for grading, sell it, alter it, clean it, press it, or send it to another service provider while a claim is pending.
24. Limited Service Remedy
If TCG Repair determines that an authorized Service was materially not performed as described, TCG Repair may, at its option:
Reperform the affected Service;
Issue a service credit;
Refund the amount paid for the affected Service; or
Provide another remedy agreed to in writing.
This section does not cover:
Permanent defects
Subjective dissatisfaction
Expected but unrealized grade increases
Market-value changes
Grading-company decisions
Customer-selected service limitations
Risks disclosed in these Terms
Damage caused by shipping or inadequate packaging
25. Limitation of Liability
To the fullest extent permitted by applicable law, the total aggregate liability of Ghostware LLC d/b/a TCG Repair and its owners, members, managers, employees, contractors, agents, affiliates, and service providers arising out of or relating to a card, order, transaction, or Service will not exceed the lowest applicable amount among:
The reasonable fair-market value of the affected card immediately before TCG Repair received it;
The declared value accepted by TCG Repair in writing before treatment began;
The applicable insurance proceeds actually recovered for the loss; or
Any lower liability limit separately agreed to in writing.
For cards with no accepted declared value, the maximum assumed value will be $100 per card, to the fullest extent permitted by law.
The service price alone does not establish a card’s value.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
26. Exclusion of Certain Damages
To the fullest extent permitted by law, TCG Repair will not be liable for:
Indirect damages
Incidental damages
Consequential damages
Special damages
Exemplary or punitive damages
Lost profits
Lost business opportunities
Lost appreciation
Lost grading premiums
Lost auction proceeds
Lost future value
Loss of use
Emotional or sentimental value
Loss based on a hypothetical grade
Difference between an expected and actual grade
Difference between an expected and actual sale price
Attorney fees except where required by law or expressly awarded under these Terms
These exclusions apply regardless of whether the claim is characterized as contract, tort, negligence, bailment, strict liability, statutory claim, or another legal theory.
27. Disclaimer of Warranties
Except as expressly stated in these Terms, the website and Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, TCG Repair disclaims all express, implied, and statutory warranties, including warranties of:
Merchantability
Fitness for a particular purpose
Noninfringement
Workmanlike result beyond applicable legal requirements
Grade improvement
Marketability
Resale value
Compatibility with grading-company standards
Complete defect removal
No employee, contractor, message, email, social-media post, photograph, video, or website statement creates a guarantee unless contained in a written agreement signed by an authorized representative of TCG Repair.
28. Customer Indemnification
You agree to defend, indemnify, and hold harmless Ghostware LLC d/b/a TCG Repair and its owners, members, managers, employees, contractors, agents, and affiliates from claims, losses, liabilities, damages, judgments, penalties, expenses, and reasonable attorneys’ fees arising from:
Your breach of these Terms
False ownership or value information
Submission of stolen or disputed property
Your violation of law
Your failure to disclose treatment when required
Fraudulent or misleading resale conduct
Your packaging or shipping decisions
Your misuse of a report or opinion
Claims by a third-party owner
Instructions provided by you
Content or materials submitted by you
This obligation does not apply to the extent a claim is finally determined to have resulted from TCG Repair’s liability that cannot lawfully be waived or shifted.
29. Counterfeit, Hazardous, or Contaminated Items
TCG Repair may isolate, refuse, or return cards that appear:
Counterfeit
Stolen
Mold-contaminated
Chemically contaminated
Infested
Wet
Biohazardous
Unsafe to handle
Unlawfully possessed
You are responsible for any reasonable isolation, cleanup, protective equipment, return, disposal, or remediation costs caused by undisclosed contamination or hazardous conditions.
TCG Repair may contact law enforcement, an insurer, a grading company, an intellectual-property owner, or another appropriate party when reasonably required by law or necessary to address suspected fraud, theft, counterfeiting, or safety concerns.
30. Unclaimed and Abandoned Orders
You must maintain current contact and shipping information and promptly respond to requests for payment, approval, address confirmation, or delivery instructions.
If an order cannot be completed or returned because you fail to respond, pay outstanding charges, provide a valid address, or accept delivery, TCG Repair may charge reasonable storage, administrative, packaging, insurance, and redelivery fees.
After at least 180 days of inactivity and reasonable attempts to contact you, TCG Repair may exercise any rights available under applicable law concerning unclaimed or abandoned property.
Before taking further action, TCG Repair may send notice to the most recent email and physical address on file.
Nothing in this section authorizes TCG Repair to disregard mandatory unclaimed-property, lien, notice, escheat, or consumer-protection laws. Property will be handled only to the extent permitted by applicable law.
31. Optional Content Permission
TCG Repair will not use identifiable photographs or video of your cards for public promotional content unless:
You provide permission;
Identifying information is removed; or
The use is otherwise permitted by law.
Content permission should be collected separately from required treatment authorization.
If you grant permission, you authorize TCG Repair to photograph, record, edit, reproduce, publish, display, and distribute approved content relating to the card and Services for educational, marketing, social-media, website, portfolio, and promotional purposes.
Unless separately agreed, you will not receive compensation or ownership rights in content created by TCG Repair.
You may revoke permission for future uses by written notice, but revocation will not require removal of materials already lawfully published, distributed, printed, or incorporated into completed content.
32. Intellectual Property
The TCG Repair website and its original content, including:
Text
Service descriptions
Photographs
Videos
Graphics
Logos
Reports
Forms
Processes
Layouts
Branding
Educational materials
are owned by or licensed to Ghostware LLC and are protected by applicable intellectual-property laws.
You may not copy, reproduce, distribute, modify, sell, scrape, republish, or commercially exploit our content without written permission.
Ownership of customer cards remains with the lawful owner. TCG Repair does not claim ownership of card artwork, game names, manufacturer trademarks, or third-party intellectual property.
33. Acceptable Website Use
You may not use the website to:
Submit false information
Impersonate another person
Attempt unauthorized access
Introduce malware
Scrape protected content
Interfere with website operation
Abuse order-tracking functions
Harass staff or customers
Commit fraud
Violate intellectual-property rights
Circumvent security or rate limits
TCG Repair may suspend access, cancel orders, or take appropriate legal action in response to misuse.
34. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
Information may include:
Contact information
Shipping addresses
Payment-related information
Order history
Card information
Declared values
Photographs
Communications
Electronic signatures
Device and website-use information
Third-party payment processors, carriers, insurers, cloud providers, communication platforms, and technical vendors may process information in connection with the Services.
35. Electronic Communications and Signatures
You consent to receive agreements, disclosures, approvals, invoices, shipping information, order updates, and other communications electronically.
You agree that electronic checkboxes, typed signatures, submission timestamps, payment records, emails, and other electronic actions may evidence your consent and authorization.
You are responsible for maintaining an accurate email address and reviewing messages, including spam or junk folders.
You should retain a copy of these Terms and your treatment authorization for your records.
36. Chargebacks and Payment Disputes
Before initiating a chargeback or payment dispute, you agree to contact TCG Repair and provide a reasonable opportunity to investigate.
Initiating a chargeback does not cancel:
An authorized Service
Shipping charges
Insurance charges
Work already completed
Your obligations under these Terms
TCG Repair may provide the payment processor with order records, electronic acceptance records, communications, photographs, shipping records, treatment records, and other documentation relevant to the dispute.
Fraudulent chargebacks may result in collection activity, order cancellation, suspension of future Services, and recovery of lawful costs.
37. Force Majeure
TCG Repair is not liable for delay, interruption, damage, or failure caused by events outside its reasonable control, including:
Carrier failures
Severe weather
Natural disasters
Fire
Flood
Power outage
Equipment failure
Internet outage
Cyberattack
Government action
Labor disruption
Civil unrest
War
Terrorism
Epidemic or pandemic
Supply shortages
Building damage
Theft despite reasonable precautions
TCG Repair will use commercially reasonable efforts to protect cards and resume affected operations.
38. Governing Law
These Terms and any dispute arising from them will be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
To the extent a dispute is not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the state courts located in Sumner County, Tennessee, or the applicable federal court with jurisdiction over Sumner County.
This section does not deprive a consumer of nonwaivable rights provided by applicable law.
39. Informal Dispute Resolution
Before filing arbitration or litigation, the complaining party must send written notice describing:

The relevant order number
The facts supporting the claim
The requested resolution

The parties will attempt in good faith to resolve the dispute for at least thirty days after receipt of the notice.

40. Binding Individual Arbitration
Please read this section carefully. It affects your legal rights.
Except for disputes eligible for small-claims court and requests for temporary injunctive relief, any dispute arising out of or relating to these Terms, the website, an order, a card, or the Services will be resolved through binding individual arbitration rather than a trial in court.
The arbitration will be administered by a mutually agreed arbitration provider under its applicable consumer rules. If the parties cannot agree, either party may ask a court of competent jurisdiction to appoint or determine an appropriate provider.
The arbitration may occur by video, telephone, written submissions, or in person, as determined under the applicable rules.
The arbitrator may award any individual remedy available under applicable law but may not consolidate unrelated claims or preside over a class, collective, or representative proceeding.
Each party is responsible for its own attorneys’ fees unless applicable law, the arbitration rules, or the arbitrator provides otherwise.
Nothing in this section prevents either party from bringing an eligible individual claim in small-claims court.
Thirty-Day Arbitration Opt-Out
You may opt out of this arbitration provision by sending written notice within thirty days after first accepting these Terms.

Opt-out notices must be sent to the mailing or email address listed in the Contact Information section.
Opting out of arbitration does not affect the remaining Terms.
41. Class-Action Waiver
To the fullest extent permitted by law, disputes must be brought only in an individual capacity.
Neither you nor TCG Repair may participate as a plaintiff, claimant, or class member in a purported class, collective, consolidated, mass, coordinated, private-attorney-general, or representative proceeding against the other.
If this waiver is finally determined unenforceable for a particular claim, that claim must proceed in court and not in class arbitration.
42. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable where permitted.
If modification is not possible, the provision will be severed, and the remaining Terms will remain in effect.
43. No Waiver
Failure by TCG Repair to enforce a provision does not waive its right to enforce that provision later.
A waiver is effective only if made in writing by an authorized representative of TCG Repair.
44. Assignment
You may not assign or transfer your rights or obligations under these Terms without TCG Repair’s written consent.
TCG Repair may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, or transfer of the TCG Repair business.
45. Entire Agreement
These Terms, together with the applicable:

Approved service summary
Treatment authorization
Liability acknowledgment
Privacy Policy
Shipping Policy
Refund Policy
High-Value Service Agreement
Written quote
constitute the entire agreement concerning the Services.
If a conflict exists, the following order of precedence applies:
A separately signed custom agreement;
The approved service summary or written quote;
The Treatment Authorization;
These Terms;
General website descriptions.
46. Changes to These Terms
TCG Repair may update these Terms periodically.
The updated version will state a revised effective date and will apply to orders submitted after the revised Terms become effective.
Material changes will not retroactively alter an already accepted order unless:
Required by law;
Necessary for safety or security; or
Agreed to by the customer.
Your continued use of the website after an update constitutes acceptance of the revised Terms for future transactions.
